The Pubic Notary in Mexico differs greatly from the notary public in the United States. In the USA, generally speaking, a Notary Public is a public official appointed by the government to serve the public as an impartial witness – a licensed public officer who administers oaths, certifies documents, and authenticates signatures on documents. Their signature confirms that, to the best of their knowledge, the person signing a document is properly identified. Usually individuals need no special training. To obtain a notary public license they must only pass a simple test, have some form of background check, or obtain a bond or insurance to insure their integrity. In the USA a non-attorney may not offer you legal advice, may not prepare documents for you and cannot recommend how you should sign something or even what type of notarization is necessary. Each state has different requirements for becoming a notary public. In some states an appointment by the legislature may be necessary. In some states all an applicant needs is a pulse and 18 years on th planet! The Public Notary in Mexico is made up of highly specialized lawyers with special judicial formation authorized by the Mexican Government in each state that works up in commercial and civil business like a public and legal advisor of investors, businessmen, and every person with such needs. Signing any kind of contract before faith and advise of a Public Notary in Mexico becomes absolute warrant of legal and judicial security. Responsibilities of Public Notary in Mexico includes: Property dealings and mortgages Titles, commercial and civil Foreign investments Financial Operations Wills, Inheritance, a Probate Arbitrations, etc. For example, if you find some property you wish to develop the Public Notary will o research to make sure that all is well and legal, and, if so, will then draw up the documents accordingly. Remembering the Terri Shaivo case of a fine family failing to leave a Will, and many other similar cases, Sr. Durazo strongly advises that everyone should have a Will. If you have a Will for property in the USA, there is probably no reason to change it, he says.
